FlashPermit Inc. (“FlashPermit,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and share your personal information when you use the FlashPermit platform.

By using the Platform, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Platform.

1. Who We Are

FlashPermit Inc. is a Delaware C-Corporation providing commercial HVAC and mechanical permit expediting services for Houston, Texas. We are the data controller responsible for personal information collected through the Platform.

2. Information We Collect

2.1 Information You Provide Directly

When you register for an account or submit a Job, we collect:

  • Full name and contact name
  • Company name and business address
  • Email address and phone number
  • TACLA licence number
  • Job details: property address, property owner name, jurisdiction, equipment specifications, and scope of work
  • Documents you upload, including AHRI certificates, equipment data sheets, distributor quotes, and photographs

2.2 Payment Information

Payment processing is handled by Stripe, Inc. We do not store your full card number, CVV, or bank account details on our systems. We receive and retain transaction identifiers, payment confirmation status, and the last four digits of your card for reference. Stripe's privacy policy governs the handling of your payment data.

2.3 Documents and Signatures

When DocuSign is used for e-signature workflows (such as COMcheck signing), the signed documents are stored in our Supabase storage as part of your Job record. DocuSign's privacy practices govern the processing of your signature data.

2.4 AI Tool Usage Data

When you use the Houston Code Checker free tool, the images or documents you upload are transmitted to Anthropic's API for AI-powered processing. We may retain the results of Code Checker analyses (including PASS/FAIL outcomes and extracted equipment data) associated with your session. We do not retain uploaded images beyond what is necessary to complete the analysis.

2.5 Automatically Collected Information

When you visit the Platform, we may automatically collect:

  • IP address and approximate location
  • Browser type and version
  • Pages visited and time spent
  • Referring URL
  • Device type

This information is used for analytics, security, and improving the Platform.

2.6 Google Ads and Analytics

We use Google Ads (Google Tag) on app.flashpermit.com to measure the effectiveness of our advertising campaigns. Google may collect information about your visits through cookies and similar technologies. You can opt out of Google's advertising tracking at adssettings.google.com.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, manage, and deliver the Services, including permit preparation, COMcheck coordination, and iPermits submission;
  • To process payments and send receipts;
  • To communicate with you about your Jobs, including status updates, document requests, and notifications;
  • To send transactional emails via Resend (job confirmation, payment confirmation, status updates);
  • To send marketing communications about FlashPermit services, where you have not opted out;
  • To improve and develop the Platform, including testing new features;
  • To detect, investigate, and prevent fraud, security incidents, and misuse of the Platform;
  • To comply with our legal obligations and enforce our Terms of Service;
  • To respond to your enquiries and support requests.

We will not sell your personal information to third parties. We do not use your data to train AI models.

4. How We Share Your Information

4.1 Service Providers

We share your information with the following trusted third-party service providers who process data on our behalf:

  • Supabase — data storage and authentication
  • Stripe — payment processing
  • Resend — transactional email
  • DocuSign — e-signatures
  • Anthropic — AI processing for Code Checker
  • Vercel — hosting and deployment
  • Netlify — marketing site hosting
  • Google — analytics and advertising

Each of these providers is contractually required to handle your data securely and only for the purposes we specify.

4.2 Legal Requirements

We may disclose your information if required to do so by law, court order, or government authority, or where we believe disclosure is necessary to protect the rights, property, or safety of FlashPermit, our users, or the public.

4.3 Business Transfers

In the event of a merger, acquisition, sale of assets, or similar business transaction, your personal information may be transferred as part of that transaction. We will notify you by email and/or a prominent notice on the Platform before your information is transferred and becomes subject to a different privacy policy.

4.4 What We Do Not Share

We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We do not share your TACLA licence number, job details, or property information with any party not directly involved in delivering your permit service.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Services. Specifically:

  • Account information is retained for the duration of your account and for 3 years after account closure, to support any post-service queries or disputes;
  • Job records, including documents, COMcheck files, and permit submissions, are retained for 7 years to support audit, legal, and compliance requirements;
  • Payment records are retained as required by applicable accounting and tax laws;
  • Code Checker session data is retained for 90 days before deletion.

You may request deletion of your account and associated data at any time (see Section 7). Certain data may be retained beyond your deletion request where required by law or for legitimate business purposes such as fraud prevention.

6. Data Security

We implement industry-standard technical and organisational measures to protect your personal information, including:

  • Encryption of data in transit using TLS/SSL;
  • Row-level security (RLS) in our Supabase database to ensure users can only access their own data;
  • Authentication controls including magic-link email authentication;
  • Access controls limiting staff access to personal data to those with a legitimate need.

No method of data transmission or storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. If you become aware of any security vulnerability or breach, please contact us immediately at hello@flashpermit.com.

7. Your Rights

You have the following rights in relation to your personal information:

Access: You may request a copy of the personal information we hold about you.

Correction: You may request that we correct any inaccurate or incomplete information.

Deletion: You may request that we delete your account and associated personal data, subject to legal retention requirements.

Objection: You may object to our use of your data for marketing purposes at any time.

Data portability: You may request a copy of your data in a machine-readable format.

8. Marketing Communications

We may send you email communications about FlashPermit services, new features, and relevant updates. You can opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email, or by emailing hello@flashpermit.com with the subject line “Unsubscribe.” You will continue to receive transactional emails related to active Jobs regardless of your marketing preferences.

9. Cookies and Tracking

The Platform uses cookies and similar tracking technologies to:

  • Maintain your authentication session;
  • Remember your preferences;
  • Measure website traffic and usage (via Google Analytics / Google Ads Tag);
  • Track advertising conversion events.

You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of the Platform.

10. Children's Privacy

The Platform is intended for use by licensed commercial contractors and is not directed at children under the age of 13. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected information from a child under 13, we will delete it promptly.

11. California Privacy Rights (CCPA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. 12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by email and update the “Last Updated” date at the top of this page. We encourage you to review this policy periodically.
